Las escrituras de las sociedades mercantiles. La traducción jurídica: Análisis contrastivo y traductológico de un texto legal norteamericano y propuesta de traducción

Abstract

Este trabajo presenta un análisis y sus resultados de un proyecto de traducción de una escritura de una sociedad mercantil norteamericana. Se trata del texto Amended and Restated Certificate of Incorporation of Continental Airlines, Inc.1, que pertenece a las lenguas de especialidad, y más en concreto, a la jurídica. En el primer capítulo se comentarán las características más importantes del español y del inglés jurídico, haciendo una comparativa de sus estructuras a nivel lingüístico así como las particularidades de las escrituras de constitución de las sociedades mercantiles. En el capítulo segundo se presenta el texto original en inglés y su traducción al español. El capítulo cuarto está dedicado al análisis textual, esto es, morfosintáctico, léxico-semántico, otras particularidades y las técnicas de traducción empleadas. Por último, como anexos, se encuentran las fichas terminológicas y los textos paralelos que han servido de guía para hacer la traducción.

This paper presents an analysis and its results of a proposed translation of a certificate of incorporation from an American corporation. Amended and Restated Certificate of Incorporation of Continental Airlines, Inc. belongs to the specialized languages, and more specifically, the legal ones. In the first chapter the most important features of the Spanish and English law will be commented, making a comparison of their structures on a linguistic level as well as the particularities of the certificate of incorporation of corporations. In the second chapter the original text in English and the Spanish translation is presented. The fourth chapter is dedicated to the textual analysis, that is, morphosyntactic, lexical-semantic, other features and translation techniques employed. Finally, as annexes, the terminology records and parallel texts that were used as a guide to make the translation.
