Contracte de maternitat subrogada – El cas del Baby M: traducció i comentari traductològic

Abstract

Com a treball de final de grau he escollit realitzar la contextualització, traducció i anàlisi traductològica de dos contractes estretament lligats entre si que tracten sobre la maternitat subrogada. El primer és un contracte que va marcar un punt d'inflexió en la història de la maternitat subrogada als Estats Units, el del Baby M, la M perquè és la primera lletra de Melissa, la nena que va néixer fruit d’aquell contracte. El Baby M va ser el primer cas de maternitat subrogada a nivell mundial que va acabar als tribunals i que va comportar la primera resolució judicial sobre aquesta matèria. En aquell cas, els tribunals nord-americans es van pronunciar a favor de la validesa del contracte en primera instància, tot i que més tard, el Tribunal Suprem de Nova Jersey, l’estat on es va presentar el cas, va revocar la decisió inicial. Tot aquell seguit de resolucions van provocar un gran enrenou i debat en la societat nord-americana dels anys 80 entre defensors i detractors d’aquesta pràctica que encara perdura i segueix molt viu avui dia. Després tenim el segon contracte, que és el que van realitzar el pare biològic de la Melissa i el centre que es va encarregar de buscar la mare subrogada. As a final paper I have chosen to do the contextualization, translation and translatological analysis of two closely interrelated contracts that deal with surrogate motherhood. The first one is a contract that marked a turning point in the history of surrogate motherhood in the United States, the Baby M, M standing for Melissa, the girl who was born fruit of that contract. Baby M was the first case of surrogate motherhood worldwide brought before justice that led to the first court ruling on this issue. In that case, the Court ruled in favor of the validity of the contract in the first instance, but later the Supreme Court of New Jersey, the state where the case was being debated, overturned the initial decision. Those whole series of resolutions caused a stir and debate in the American society of the 80’s between those in favor and those against this practice that still remains nowadays. Then there is a second contract, signed between the natural father of Melissa and the center that contacted the surrogate mother. Both contracts are presented together in the website where I found the original text that is the basis of this paper.
